TERMS & CONDITIONS

- PAYMENT AND RESERVATION

Provisional confirmation: Once a reservation is provisionally confirmed, the Villa(s) will be held temporarily in good faith for the tenant.

Rates, Advance and Balance Payments:

Rate is determined during the reservation process.

Advance Payment: 50% of the total villa rental rate is required to confirm the booking. The advanced payment can be made by bank transfer. Payment amount is net of (after) any bank charges at senders end.

Balance Payment by Bank Transfer: 50% of the total villa rental rate shall be due prior to your arrival (exact time frame determined at reservation). If the balance is not received, you may be refused entry into the villa or the booking may be cancelled at the Owners discretion.

Balance Payment On Arrival: Only CASH payments are accepted when the balance is paid on arrival (no credit cards and no bank transfers will be accepted. If the balance is not received within 30 minutes of your arrival, the booking may be cancelled at the Owners discretion and you may be asked to leave the villa.

*Other Payment Arrangements:

1) Guests can choose to pay 100% of the villa rental rate at the time of the reservation. This payment can be made by bank transfer. Payment amount is net of (after) any bank charges at senders end.

2) Guests can choose to pay an advance payment of 75% of the total villa rental rate at the time of the reservation. This payment can be made by bank transfer. Payment amount is net of (after) any bank charges at senders end.

The balance payment of 25% of the total villa rental rate is due on arrival in CASH ONLY. If the balance is not received within 30 minutes of your arrival, the booking may be cancelled at the Owners discretion and you may be asked to leave the villa.

- OCCUPANCY

Maximum tenants that can reside at the property, is as per booking. Number of guests must be confirmed with the Villa prior to a booking confirmation and cannot be modified unless it is accepted by the Villa.

Failure to advise us of any changes in the group numbers and makeup prior to guest arrival will result in penalty fees (up to 5000 Thai bath per person per day) or in extreme cases it can lead to cancellation of the booking. Daytime visitors/friends of guests are allowed as long as the group number does not exceed about twice the overnight occupancy.

*Policy for all-men bookings: The number of men cannot exceed the number of beds.

The tenant is responsible for the behavior of any other guests they invite inside the villa and any damages, costs or other problems arising from them.

- CANCELLATION POLICY

  • Peak season (19 Dec. - 15 Jan.):

    • Advanced and Balance payments are non-refundable if for any reason a cancellation is made before the check-in date.

  • High season (16 Jan. - 31 May and 1 Nov. - 18 Dec.):

    • Advanced and Balance payments are non-refundable if for any reason a cancellation is made before the check-in date.

  • Low season (1 Jun. - 31 Oct.):

    • Advanced payment/deposit is non-refundable if for any reason a cancellation is made before the check-in date.If cancellation is made after the final Balance payment, 60% of the final balance payment will be refunded.

- CHECK-IN/CHECK-OUT TIMES

Check in time is 2:00pm, check out time is 12:00pm (noon). This may be flexible depending on availability, please ask us for information.

- SECURITY DEPOSIT

A security deposit may be required for your reservation. If such is the case, it is payable in cash to the villa manager when you check-in. This is to cover the cost of any damage or breakages to the Villa(s) and/or its/their content during the rental period. This amount will be returned to you when you check out, less any such costs.

The exact amount of the deposit will be determined by the Villa owner during the reservation process.

- Electricity

Electricity is charged at 7 THB/unit (kWh). A photo of the official meter is taken during your check-in and another one at check-out. We kindly ask you to settle this bill before leaving. You can expect to pay about 850 THB per day. This will cover normal usage (i.e. air conditioning in each room during the night). You can expect additional costs for excessive use (i.e. leaving the air conditioning running all day and night and while you are not in the villa). While still a minimal cost, this policy is in place to avoid wastage and preserve our beautiful island!

- INSURANCE AND VALUABLES

The tenant and all users of the Villa(s) should have their own personal accident and medical insurance. The tenant is not permitted to claim on the Villa(s) insurance for personal accident and sickness issues. The Villa(s) has/have a standard insurance policy. It does not cover valuables of the tenant such as cash, jewelry, phones, computers etc. It does not cover misuse of the villa(s) and damage resulting from it. The tenant is required to use lock safes provided in each bedroom, for valuables including passports. Any valuables left at the property are the guest’s sole responsibility. Neither the Villa(s) nor the owner nor the staff can be held responsible for any loss or damage of personal property. The tenant is responsible for securing and locking the premises when leaving the villa(s) unattended.

- LIABILITY RELEASE

Under no circumstances shall the Villa(s) or the owner be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodation as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted.

- COMPLAINTS

The Villa(s) accept/s no responsibility for any modifications made which are not mentioned on the website or anywhere else. The Villa(s) cannot be held liable for the breakdown of the supply of water, electricity, internet or TV systems, though we will do our best to arrange for any such problems to be solved quickly. It is understood that infrastructure, local standards and conditions are often less developed in a remote resort location than in more urban environments. Any claims by the tenant for such a breakdown shall be limited to a negotiated refund of part rent money only, or finding of same priced accommodation at a nearby location. The Villa(s) shall not be liable for any further obligations or claims by the tenant.

- LINEN, TOWELS AND LAUNDRY

Linen and towels are provided at the villa(s). Linen is changed every 3 days and towels are changed as needed. If you require more frequent changes there may be small extra charges. Laundry services can be provided at an extra charge.

- MAID SERVICES

Maid services are complimentary 6 days per week (not on Sundays). Rooms are cleaned once a day, during the day. If you require additional maid services or services outside of regular working hours, additional charges will apply.

- USE OF THE KITCHEN

We are happy to provide a fully equipped kitchen for all our guests to use at their convenience. However, we ask our guests to keep the kitchen clean at all times which includes storing food products properly (sealed or in the refrigerator), to wipe clean all the counters after each use and to avoid keeping food lying around for too long without attendance. This is not only for aesthetic purposes, but mostly to avoid attracting any unwanted insects which is to the benefit of all the current and future guests.

For any additional kitchen cleanings by the staff, charges will apply.

- CONDUCT AND BEHAVIOUR

Smoking is permitted only on the villas’ outdoor areas/decks. The person paying the deposit for the villa(s) rental is responsible for the correct and appropriate behavior of the guests staying at the Villa(s). Should any member of the party behave in a manner considered inappropriate, the villa manager or the owner may at their absolute discretion ask the offending guest or guests to vacate the Villa(s) forthwith. In such a case, this will be treated as a cancellation of the original booking and no refund can be claimed from either the Villa(s) or the villa owner.

We ask our guests to be mindful of their surroundings and to respect a few simple guidelines such as avoiding playing very loud music outside/screaming in the middle of the night, to respect our villa manager and staff, and to avoid at all cost waking them up in the middle of the night, unless it is urgent. Do not smoke inside the villas, smoking is permitted outside only.

- SALES INSPECTIONS OF THE VILLAS

The villa(s) is/are for sale. The tenant agrees to allow the Owner or Villa Managers to show the Villas to prospective buyers during the term of this agreement. This will be a guided tour of 30 minutes maximum each. 24 hours notice will be given, and hours will be limited to 11am to 4pm, Monday to Saturday. Exceptions to these terms may only be made with approval of the Tenant. The Tenant has the option to request alternative viewing times, to those selected by the Owner/Manager, and this will be accommodated as much as possible.

- AIR CONDITIONING

Please turn off the air conditioning at all times when leaving the room. Do not put air conditioning lower than 21° and do not leave doors and windows open when the air conditioning is functioning.

- SECURITY

Please do not leave any computers, watches/jewelry, wallets/money, cameras, or any other object of value outside unattended when you leave the villa for the day/night. The villas are equipped with outdoor cameras and gated private parking. Although it is relatively safe, we recommend our guests to be cautious just as a precaution.

There are safes in every room for your valuables such as passports, jewelry, money, etc... Although computers do not fit in the safe, when leaving the villa, it is always good to leave your computer in your room.  Also, when leaving the villa or at night, it is always good to lock all the doors, including the doors in the bedrooms that lead to a balcony.

Finally, when inviting people/friends at the villa, it's best to store your valuables in your safe and/or bedroom where they cannot be seen.
